How to Win Your Bond Back in NSW: The Complete NCAT Guide

One of the most common problems renters in New South Wales face is a landlord or agent trying to claim their bond for "damages" that are actually just fair wear and tear. If you are stuck in a stalemate, you need to know about the Rental Bond Board and NCAT.

Step 1: The Race to the Button

In NSW, the first person to claim the bond online often has the upper hand. You do not need to wait for your agent to sign off on the refund.

  • Log into Rental Bonds Online (RBO) as soon as you hand back the keys.
  • Submit a claim for the full amount.
  • The agent then has 14 days to dispute it. If they don't, the money is deposited into your account automatically.

Step 2: Fair Trading Mediation

If the agent disputes your claim, Fair Trading NSW will ask you to provide evidence. This is where your Incoming Condition Report and photos are vital. If mediation fails, the matter goes to the Tribunal.

Step 3: Going to NCAT

The NSW Civil and Administrative Tribunal (NCAT) is designed for self-representation. You do not need a lawyer.

  • Stick to the facts: The Member doesn't need to know the agent was rude, only that the carpet stain was there when you moved in.
  • Bring 3 copies of everything: One for you, one for the Member, one for the agent.
  • Calculate depreciation: If a carpet is 10 years old, it has zero value. A landlord cannot claim 'new for old' replacement costs.

Remember, the burden of proof is on the landlord to prove you caused damage. If they have no evidence, they have no case.
